Terms and Agreement

THIS USER AGREEMENT (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and Fairways Indoor Golf (“Company,” “we,” “us,” or “our”) governing your use of the golf simulator facilities and services (“Services”) at 2066 Nevada City Hwy. Grass Valley, CA 95945. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with all terms, do not use the Services.

1. Eligibility & Acceptance
1.1. You must be at least 18 years old to use the simulator.
1.2. Minors under 18 must be accompanied and directly supervised by a responsible adult at all times while using the facilities. No unattended minors are permitted.
1.3. By using the Services, you represent that you meet these requirements and agree to comply with all terms herein.

2. Use of Space & Time Slots
2.1. All Users must reserve a specific time slot prior to use.
2.2. You agree to use the space only during your allotted reservation time. If you exceed your reserved time without approval, additional charges may apply, and subsequent reservations may be delayed or canceled.
2.3. Late arrivals do not extend your reservation slot.
2.4. We reserve the right to refuse entry if you arrive significantly after your scheduled time.

3. Prohibited Conduct
3.1. No drug or alcohol use is permitted on the premises. Possession or use of illegal drugs and intoxication from alcohol while using the Services will result in immediate termination of your reservation and possible trespass by law enforcement.
3.2. You may not bring any illegal substances or behave in any way that endangers others, violates law, or damages equipment or property.
3.3. Users must follow all posted safety instructions and staff directions.

4. Assumption of Risk & Waiver
4.1. Use of the golf simulator and related equipment involves inherent risks, including physical injury. You voluntarily assume all risks associated with your use.
4.2. To the fullest extent permitted by law, you release, waive, and discharge Fairways Indoor Golf and its affiliates from any and all liability for injury, loss, or damage arising from your use of the Services, including premises or equipment.
4.3. You agree to indemnify and hold Fairways Indoor Golf harmless from any claims, damages, or costs (including attorneys’ fees) arising from your actions or use of the Services.

5. Payment & Cancellation
5.1. Reservation fees must be paid in full at the time of booking.
5.2. Cancellations or changes must be made at least 24 hours prior to the reserved time to receive a refund.
5.3. No-shows or late cancellations may forfeit the reservation fee.
5.4. Time lost due to early departure or lateness is non-refundable.

6. Damage & Responsibility
6.1. You are responsible for any damage to equipment or facilities caused by misuse, neglect, or reckless behavior.
6.2. Repair or replacement costs may be charged to you.
6.3. Report any equipment malfunction immediately to staff or management.

7. Termination & Enforcement
7.1. We may refuse access or terminate your reservation at our discretion for violation of this Agreement, unlawful activity, or unsafe conduct.
7.2. Upon termination, you must immediately leave the premises.
7.3. You are not entitled to a refund for terminated sessions caused by your violation of these terms.

8. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of California without regard to conflict of law principles.

9. Entire Agreement
This Agreement constitutes the entire understanding between you and the Company with respect to the subject matter and supersedes all prior or contemporaneous agreements. Any amendment must be in writing and signed by both parties.
